Scope of Application and Definitions
These General Terms and Conditions of Sale and Use (hereinafter referred to as "GTCU") govern all relationships between the company Godot Net SAS, operator of the Bijoux d’Antan platform, Sellers (Godot et Fils agencies and affiliated partners), and Buyer Customers (hereinafter collectively referred to as "Users"), in the context of purchasing new and second-hand jewelry via the online platform accessible at https://bijouxdantan.fr.
Definitions:

"Platform": The Bijoux d’Antan website and online interface operated by Godot Net SAS, facilitating the connection between Sellers and Buyers and the conclusion of sales of new or second-hand jewelry.

"Seller": Any agency belonging to the Godot et Fils group or any affiliated partner, a duly authorized professional, who sells jewelry via the Platform.

"Buyer" or "Customer": Any natural person of legal age or legal entity that purchases one or more pieces of jewelry via the Platform.

"Jewelry": Any item of jewelry, watch, gem-set piece, precious metal item, new or second-hand, offered for sale on the Platform.

"Second-hand Jewelry": Any jewelry previously acquired by a Seller from a third party and resold via the Platform, subject to the obligation of maintaining a police register.

"Order": The operation by which the Buyer selects one or more pieces of Jewelry on the Platform, pays the price, and validates the sale under the conditions set out herein.

"Customer Account": A personal space optionally created by the Buyer, allowing them to track their Orders and, where applicable, manage their information.

"Services": All services provided by the Platform, including connection, presentation of Jewelry, payment management, and delivery organization.
The present GTCU are accessible at any time on the Platform and shall prevail, where applicable, over any other conflicting version or document.
Identity of the Operator
The present General Terms and Conditions of Sale and Use (hereinafter referred to as "GTCU") govern all relationships between the company Godot Net SAS, operator of the Bijoux d’Antan platform, Sellers (Godot et Fils agencies and affiliated partners), and Buyer Customers (hereinafter collectively referred to as "Users").

Godot Net SAS, via the website https://bijouxdantan.fr, acts as an online platform operator under Article L.1117 of the French Consumer Code, as a marketplace specializing in connecting buyers and sellers of new and second-hand jewelry.
Godot Net SAS operates:
- The Bijoux d’Antan online platform accessible at https://bijouxdantan.fr
- One or more physical stores (hereinafter referred to as "the Store") for the presentation and sale of new and second-hand jewelry.
These GTCU apply to sales made:
- Online via the Platform
- In-store when the Customer refers to these terms (display in-store, QR code linking to the website, provision of a paper or PDF copy).
Purpose of the Platform and Roles of the Parties
Purpose of the Platform
Bijoux d’Antan is a marketplace specializing in the sale of new and luxury second-hand jewelry, offered by Godot et Fils agencies and selected partners. The jewelry offered may include, but is not limited to, prestige watches, signed jewelry from major houses, vintage jewelry, gold, silver, platinum, precious and semi-precious stones, and generally any authenticated piece of jewelry.
Role of the Platform
Godot Net SAS provides a platform for presenting jewelry, connecting buyers and sellers, managing technical payments, and organizing delivery.
Sellers remain solely responsible for the availability of the jewelry, the accuracy of descriptions, and the guarantee of authenticity, except when Godot Net SAS itself owns the jewelry.
When Godot Net SAS acts as the owner of the jewelry, the sale is concluded directly between Godot Net SAS and the Buyer; otherwise, the sale is concluded between the partner Seller and the Buyer, with Godot Net SAS acting as an intermediary.
In-Store
Bijoux d’Antan is a marketplace specializing in the sale of new and luxury second-hand jewelry, offered online via the Platform and, where applicable, in-store.
In-store, jewelry may be offered:
- Directly by Godot Net SAS
- On behalf of partner Sellers under consignment or commission sale agreements.
When the sale is made in-store, the invoice or sales receipt specifies whether the Seller is Godot Net SAS or a partner.
Acceptance of the GTCU
Any navigation on the Platform and any Order implies the full and unconditional acceptance of these GTCU by the User, materialized by a checkbox during the validation of the Order.
Conditions of Access and Use
Access to the Platform
Access to the Platform is free for any User with internet access. Viewing the jewelry does not require the creation of an account. However, placing an Order requires the communication of certain personal data necessary for processing the sale, delivery, and compliance with AML/CFT obligations.
The following information may be collected to ensure the smooth processing of your order:
- Identity: First name, last name
- Home address
- Phone number
- Email address
- ID document (AML/CFT control)
Account Creation (if enabled)
The Platform may offer the creation of a Customer Account via an email address and/or phone number, possibly accompanied by a validation procedure (SMS/OTP).
The Buyer undertakes to provide accurate, complete, and up-to-date information and not to impersonate a third party.
In-Store
Simply entering the Store and viewing the jewelry is free and does not require the creation of an account.
The information necessary for the sale, compliance with AML/CFT obligations, and invoicing is collected directly at the counter.
Minimum Age
The Platform is reserved for natural persons aged at least 18 and legally capable, or legal entities represented by a duly authorized representative.
Fair Use
The User undertakes not to use the Platform for fraudulent or illegal purposes, not to impair its proper functioning, or to attempt to access its systems or data without authorization.
Presentation of Jewelry
Product Information
For each piece of jewelry, a detailed product sheet presents the essential characteristics, including:
- Nature of the jewelry (watch, ring, bracelet, etc.)
- Material(s) and metal fineness (alloys from 375‰ to 999‰ where applicable)
- Weight, dimensions, size
- Brand, collection, period, or style (vintage, contemporary, etc.)
- Condition (new, very good condition, good condition, used condition, etc.)
- Possible presence of stones (nature, type of cut, carat weight, certificates, etc.)
- High-definition photographs, possibly videos and 360° views
- Selling price including VAT, mention of applicable VAT (VAT on margin where applicable)
Authenticity and Certificates
The jewelry is pre-authenticated by jewelry experts (Godot et Fils or partners). Where applicable, a numbered certificate of authenticity accompanies the jewelry, along with any gemological laboratory reports.
Resizing and Personalization
Resizing, polishing, rhodium plating, engraving, or any other personalization service may be offered as an option, under conditions and prices specified on the Platform or in the product sheet. These services may affect the right of withdrawal.
Prices, Taxes, and Fees
Displayed Prices
Prices are indicated in euros, all taxes included (VAT) where applicable, excluding delivery fees unless otherwise stated.
For second-hand jewelry subject to VAT on margin, the invoice or purchase summary will mention this particularity and will not show deductible VAT.
VAT
- New jewelry: VAT applied to the total price at the current rate.
- Second-hand jewelry: possible application of the VAT on margin scheme, in accordance with current regulations, as mentioned on the documents provided to the Buyer.
Delivery Fees
Delivery fees are indicated during the Order process. A possible free delivery threshold (e.g., for purchases over €1,000) may be applied and is specified on the Platform.
Order Process and Contract Formation Online
Order Steps
The Buyer is informed of the following steps:
- Selection of one or more pieces of jewelry and addition to the cart.
- Access to the cart summary and consultation of essential characteristics, prices, fees, and applicable conditions.
- Communication of necessary information (delivery address, billing, AML/CFT data where applicable).
- Acknowledgment and acceptance of these GTCU (checkbox).
- Choice of delivery method and payment method from those offered.
- Validation of the Order and initiation of the payment request.
Acceptance of the GTCU
Before finalizing their Order, the Buyer must check a box by which they acknowledge having read and accepted without reservation the GTCU.
Order Confirmation
Once payment is validated, the Order is confirmed by sending a summary email to the Buyer, specifying in particular the order number, details of the jewelry purchased, the total price paid, and delivery terms.
Proof
The data recorded by the Platform and the payment provider constitute proof of all transactions concluded with the Buyer, unless proven otherwise.
Order Process and Contract Formation In-Store
In-store, the sales process is as follows:
- Presentation to the Customer of one or more pieces of jewelry, with communication of essential characteristics (nature, weight, metal, brand, condition, VAT-inclusive price, VAT regime, etc.).
- Where necessary, collection of identification documents and information required under AML/CFT obligations and the police register (particularly for second-hand jewelry and buy-back operations).
- Acceptance of the price by the Customer and optional choice of additional services (resizing, engraving, workshop services, transport insurance in case of shipment, etc.).
- Issuance of a receipt, invoice, or sales certificate, formalizing the acceptance of the sale and, where applicable, a reference to these GTCU (via link or QR code).
In-store, the sale is concluded upon full payment of the price by the Customer, unless otherwise stipulated (special order, deposit, etc., detailed on the document provided).
In-store, there is no right of withdrawal.
Online Payment
Payment Methods
Payments can be made, in particular, by:
- Bank card (CB, Visa, Mastercard, etc.) via a secure payment service provider (PSP).
- SEPA bank transfer, under the conditions and deadlines indicated.
Payment Security
Bank card payments may be subject to enhanced authentication (3D Secure or equivalent), in accordance with current regulations. The Buyer guarantees that they have the necessary authorizations to use the chosen payment method.
Payment Default
In the event of payment refusal by the banking institution or incident, the Order is automatically canceled, and no jewelry will be shipped.
In-Store Payment
In-store, accepted payment methods may include, subject to the limits displayed on-site:
- Cash, within legal limits.
- Bank card.
- Prior or immediate bank transfer.
Specific conditions (e.g., no cash acceptance beyond a certain amount, bank transfer validation deadline) are displayed in-store and can be recalled to the Customer upon request.
Delivery/Handing Over of Jewelry
Online Sales
Delivery Methods
Jewelry is delivered via specialized carriers chosen by the Platform, offering secure shipping and delivery against signature. The methods (Chronopost expert, private courier, or equivalent partner) are specified during the Order.
Deadlines
Indicative delivery deadlines are indicated during the Order (e.g., 3 to 15 business days in metropolitan France). Reasonable delays due to external causes (strikes, congestion, transport incidents) cannot engage the responsibility of the Platform, subject to the consumer's imperative rights.
Shipping Fees and Serviced Areas
Shipping fees are calculated and displayed before Order validation, depending in particular on the total cart amount, the chosen transport method (Colissimo, Chronopost, DHL, Declared Value, or equivalent carrier), and the destination.
In metropolitan France, the Platform may offer:
- Free shipping above a certain purchase amount, indicated on the Platform (e.g., from €1,000).
- Flat-rate fees for orders below this threshold, the amount of which is indicated during the Order summary (e.g., €10 to €20 depending on the chosen method).
For shipments to the European Union or outside the European Union, specific shipping fees may apply; they are calculated before payment and communicated to the Buyer. Customs duties, import taxes, or any fees that may be required upon arrival in the destination country remain the sole responsibility of the Buyer.
Given the nature of the jewelry (valuable items), the Platform favors secure shipping methods (registered, declared value, or equivalent) including tracking and enhanced compensation in case of loss or theft, in accordance with the specific conditions of each carrier.
Insurance
Shipments can be insured up to the declared value of the jewelry, until delivery against signature to the Buyer.
Transfer of Risks and Ownership
The transfer of ownership occurs upon full receipt of the price by the Seller or the Platform when it acts on its own behalf; the transfer of risks occurs upon physical delivery of the jewelry to the Buyer or to any person designated by them.
Verification upon Delivery
The Buyer is invited to verify the condition of the package in the presence of the delivery person and to make any necessary reservations in case of damage or an open/damaged package, on the delivery note. In the absence of reservations, the jewelry is deemed delivered in conformity with its packaging.
In-Store Sales
In-store, there are two scenarios:
- Immediate handover in person: the transfer of risks and ownership occurs upon delivery of the jewelry to the Customer, after full payment.
- Shipment at the Customer's request (e.g., home delivery after in-store purchase): the secure transport terms, indicative deadlines, insurance, and fees are specified to the Customer before validation and mentioned on the invoice or pickup slip.
In the second case, the rules for verifying the package, reservations to be made, and procedures in case of damage apply in the same way as for an online sale.
Right of Withdrawal and Returns – Distinction Between In-Store and Online
Legal Deadline
When the Buyer has consumer status, they benefit from a 14-day period from receipt of the jewelry to exercise their right of withdrawal, without having to justify their decision.
Exclusions
The right of withdrawal does not apply, in particular, to:
- Jewelry that has been subject to specific personalization or modification at the Buyer's request (engraving, resizing, etc.).
- Jewelry purchased in a physical store and not via the Platform.
Exercise Modalities
To exercise their right of withdrawal, the Buyer informs the Platform within the legal deadline by any written means (email, online withdrawal form), specifying the order number and the jewelry concerned.
Return of Jewelry
After agreement, the Buyer has a maximum of 7 days to return the jewelry, in its original condition, unworn, complete (case, certificates, accessories, invoices), and in secure packaging suitable for its value.
Depending on the Platform's policy, the terms and coverage of return fees (at the Buyer's expense or the Platform's) are specified on the website.
Refund
Subject to compliance with the return conditions, the refund is made within a reasonable time and, in principle, via the same payment method as that used for the Order, excluding any additional fees.
Legal and Commercial Warranties
Legal Warranty of Conformity
The Buyer, as a consumer, benefits from the legal warranty of conformity provided for by Articles L.217-3 et seq. of the French Consumer Code, for new and second-hand goods. In case of non-conformity (e.g., major discrepancy with the description), the Buyer may request compliance, price reduction, or termination of the sale under legal conditions.
Warranty for Hidden Defects
Regardless of the warranty of conformity, the Buyer benefits from the warranty for hidden defects provided for by Articles 1641 et seq. of the French Civil Code, for jewelry.
Authenticity
The authenticity of the jewelry is guaranteed by the Sellers and, where applicable, by Godot Net SAS when the jewelry belongs to them. In case of serious dispute over authenticity, an expertise may be requested from an independent expert, under conditions to be defined between the parties.
Commercial Warranty
Where applicable, a commercial warranty (duration, scope, exclusions) may be offered by the Seller or the Platform for certain jewelry, as indicated on the product sheet or invoice.
Warranties – Channel Clarification
Legal warranties (conformity, hidden defects) apply equally to online and in-store sales, under the same conditions. Any commercial warranties (duration, terms) may differ between online and in-store purchases; their scope is specified:
- On the product sheet for an online sale.
- On the invoice or documents provided to the Customer for an in-store sale.
Anti-Money Laundering and Counter-Terrorist Financing (AML/CFT)
Status and Obligations
Godot Net SAS and the Godot et Fils agencies are subject to AML/CFT obligations applicable to professionals in the precious metals and jewelry sector, including the French Monetary and Financial Code. As such, they implement vigilance measures regarding customers and transactions and may be required to file suspicious activity reports with TRACFIN.
Customer Identification
For certain operations (particularly purchases or sales above certain thresholds, operations deemed risky, business relationships), enhanced identification of the Buyer and/or Seller is required, including:
- Collection and retention of a copy of a valid official ID document.
- Collection of proof of address.
- Collection of additional information on the origin of funds or goods.
Police Register and Data Retention
For second-hand jewelry, Sellers maintain a register (police register) mentioning the mandatory details relating to acquisition and resale, including the identity of the initial seller, the description of the jewelry, and useful references. The data collected in this context are retained for the legal durations (notably 5 years after the end of the business relationship for AML/CFT obligations).
Refusal of Transaction
In case of refusal to provide the information or documents necessary for vigilance, the Platform and/or Sellers reserve the right to refuse or cancel any transaction, without any liability other than the refund of any amounts collected, except in cases of suspicion.
Personal Data Protection (GDPR)
Data Controller
Personal data collected via the Platform is processed by Godot Net SAS, acting as the data controller, for the purposes described below.
Data Protection Officer (DPO)
A Data Protection Officer has been appointed by Godot Net SAS. Customers, Sellers, and partners can contact the DPO directly at: dpo@godotetfils.com.
Collected Data
Categories of data may include:
- Identification data (name, first name, date of birth, ID document, etc.).
- Contact details (postal address, email, phone).
- Transaction data (amount, nature of jewelry, payment method).
- Data necessary for AML/CFT (PEP, origin of funds, etc.).
- Navigation data (cookies, logs).
Purposes
Data is processed, in particular, for the following purposes:
- Management of Orders, payments, and deliveries.
- Customer relationship management and after-sales service.
- Compliance with legal and regulatory obligations (AML/CFT, police register, taxation).
- Platform management and Service improvement.
- Commercial prospecting and newsletters (with prior consent where required).
Legal Basis
Processing is based on:
- Performance of the sales or service contract.
- Compliance with legal or regulatory obligations.
- The legitimate interest of the Platform.
- The consent of the data subject for certain purposes (electronic prospecting, non-essential cookies, etc.).
Recipients
Data may be transmitted to Sellers, technical service providers (hosting, transport, PSP), advisors, administrative or judicial authorities, to the extent necessary for the execution of Services and legal obligations.
Retention Period
Data is retained for the duration necessary for the management of the contractual relationship, increased by the legal limitation periods, and longer where required by law (e.g., 5 years for AML/CFT data after the end of the business relationship).
Rights of Individuals
In accordance with the GDPR and the French Data Protection Act, any person has the rights of access, rectification, erasure, restriction, portability, and objection, which they can exercise by writing to dpo@godotetfils.com or to the postal address of the head office, subject to proof of identity. They also have the right to lodge a complaint with the CNIL.
Privacy Policy
A detailed privacy policy is available on the Platform, specifying the terms of processing of personal data and the use of cookies.
Intellectual Property
All elements of the Platform (texts, photographs, videos, logos, graphic charter, databases, etc.) are protected by intellectual property rights. Any reproduction, representation, adaptation, or exploitation, total or partial, of the Platform's content without prior written authorization from Godot Net SAS and/or the rights holders is strictly prohibited.
Liability
Platform Liability
Godot Net SAS undertakes to provide access to the Platform and Services with diligence and according to the rules of the art, subject to interruptions necessary for maintenance, updates, or force majeure.
The Platform is only liable in its capacity as an operator and, where applicable, as a Seller when the jewelry belongs to it, within the limits of the mandatory legal provisions.
Seller Liability
Each Seller is solely responsible for the jewelry they offer, its availability, the accuracy of the information, compliance, and authenticity. In the event of a dispute relating to jewelry from a partner Seller, the Platform may assist the Buyer in their efforts to find a compromise but does not assume the Seller's own responsibility, unless the law provides otherwise.
Force Majeure
Neither party shall be liable for any failure resulting from an event of force majeure as defined by the jurisprudence of the French courts (strikes, natural disasters, pandemics, widespread outages, etc.).

The Platform endeavors to process requests as quickly as possible.
Mediation and Dispute Resolution
In the event of an unresolved consumer dispute with customer service, the consumer Buyer may refer the matter free of charge to a consumer mediator, whose contact details are provided on the Platform (e.g., a specialized mediator or Mediation.fr). The Buyer may also use the European Online Dispute Resolution platform (ODR).
Applicable Law and Jurisdiction
These GTCU are governed by French law. In the event of a dispute, and failing an amicable solution or mediation, the competent French courts will be seized. When the Buyer is a consumer, the mandatory rules of jurisdiction apply.
Modification of the GTCU
Godot Net SAS reserves the right to modify these GTCU at any time. The applicable version is the one in force on the day of the Order, as accepted by the Buyer during validation.
